The Litigation
Department is a key
component of the firm. It offers legal advice and assistance to our
clients in dispute resolution, whether in the context of actual judicial
proceedings, in arbitration, or in mediation.
This department has achieved significant recognition in all areas of
commercial litigation and damages, including contract tort actions, Act 75
litigation under the Puerto Rico Dealers' Statute, construction defects,
products liability and other related areas, before both local and federal
courts. The Department has also been extensively involved in civil rights
litigation as employers' counsel in extremely sensitive cases. In
addition, the Department contains a practice group dedicated exclusively
to bank related litigation, which includes both commercial and contractual
disputes collections and foreclosure actions, as well as lender liability
lawsuits. With a high number of favorable published opinions to their
credit, the members of the Department on occasion have been able to
establish legal precedent at the national level as well as at the state
level.
The Litigation Department
enjoys a highly diversified practice. In addition to commercial
litigation, it engages in anti-trust, bankruptcy, product liability, civil RICO, and
insurance and distributorship cases.
In
the bankruptcy field, this department generally represents creditors,
although it has also represented large multinational corporations in their
efforts to reorganize under the provisions of Chapter 11 of the United
States Bankruptcy Code. For example, our bankruptcy specialists achieved
the successful confirmation of a Chapter 11 Plan of Reorganization
proposed by a multinational pharmaceutical company.
