The Environmental Law
Department focuses its efforts on the practical solution of complex
environmental issues. It assists our clients in the process of selecting
the appropriate sites for new business activities in Puerto Rico. It also
spearheads their efforts to obtain the required permits from the Puerto
Rico Environmental Quality Board (the EQB), as well as from the
corresponding federal authorities of the United States.
The Environmental Law Department has been engaged in
the planning, development, and permitting of major industrial and
infrastructure projects in the Commonwealth of Puerto Rico.
It works closely with our clients and with the
designated governmental agencies to delineate an appropriate strategy for
regulatory compliance and for the efficient approval of legally mandated
permits. At times, it has lobbied on behalf of our clients before the
Puerto Rico legislature in order to define more clearly the Puerto Rico
environmental statutes and/or regulations. In fact, it has submitted
draft, proposed regulations for the consideration of the Puerto Rico EQB
and the Puerto Rico Solid Waste Management Authority (SWMA). At present,
the Environmental Law Department is preparing draft amendments to the
Puerto Rico Public Policy Environmental Act.
Finally, this Department was instrumental in
obtaining the required permits for one of Puerto Rico's most challenging
industrial-infrastructure projects, to wit: the government sponsored
programs to expand Puerto Rico's ability to generate electrical energy
from a variety of sources. Together with the Puerto Rico Industrial
Development Company, the Environmental Law Department has developed the
first Brownfields Program in Puerto Rico ---i.e., a program designed to
encourage business entities
to acquire properties that have sustained environmental damages and
to convert them to productive uses through clean-up efforts.
